Having just completed an employment trial that lasted over 7 weeks and resulted in a hung jury, thus a mistrial, I find myself reflecting once again on the state of employment law in California – and unfortunately, not in a positive way. This is a discussion I have with myself (and anyone who happens to be around me in the 6 months following trial) after each of the many trials in which I have been involved over the past 15 years. Don't get me wrong – I truly enjoy trial work and find it invigorating. Nailing an expert during cross-examination is one of my favorite things to do. Catching the plaintiff in a case changing lie definitely gets my adrenaline pumping. That said, the enjoyment I take from honing my craft does not mean that the system works.
